COMMITTEE RECOMMENDATIONS

At the May 11, 2017 (Item No. 7) meeting of the Finance and Government Operations Committee (FGOC), the Administration presented a report on a proposed Donation and Sponsorship policy for County Departments and Board of Supervisors offices.  The Committee endorsed the Administration’s recommendation that the Policy be forwarded to the Board of Supervisors for consideration.

FISCAL IMPLICATIONS

There are no fiscal implications associated with the recommended action.

REASONS FOR RECOMMENDATION

On April 23, 2019 (Item No. 9), the Board approved a referral to the Administration and County Counsel to draft language for Board approval that requires appropriate recognition of County support of events that are sponsored or co-sponsored by the County.

The proposed Policy limits the use of County Assets for Donations and Sponsorships.  It is envisioned that the Policy will be implemented in detail by Administrative procedures established by the County Executive.

The proposed Policy is silent on the sources of County funds that may be used for a donation or sponsorship and does not establish limits on annual donations or sponsorships that are made by a single Agency/Department or Board Member.

BACKGROUND

At the January 10, 2013 (Item No. 5) FGOC meeting, the Director of the Finance Agency presented audit findings regarding the Procurement Card (P-Card) transactions of all Supervisorial Districts and Object 2 Expenditures of District 2.  The audit of the Object 2 expenditures for District 2 stated that a clear policy addressing donations of County funds needs to be established by the Board.  At the meeting, Committee members directed County Counsel to provide a means for the Board of Supervisors to immediately prohibit the donations of County funds on an interim basis. 

At the January 15, 2013 (Item No. 61) Board of Supervisors meeting, the Board adopted Resolution BOS-2013-4 establishing a moratorium prohibiting the use of County funds for donations without specific Board of Supervisors approval.

At the May 11, 2017 (Item No. 7) FGOC meeting, the Administration provided a report on a proposed Donation and Sponsorship policy for County Agencies/Departments and Board of Supervisors officesAt this meeting, the Committee requested additional information and endorsed the Administration’s recommendation that the Policy be forwarded to the Board of Supervisors for consideration.

At the August 15, 2017 (Item No. 24) Board meeting, the Administration recommended the Board rescind Resolution BOS-2013-4 and adopt a County Donation and Sponsorship Policy for County Departments and Board of Supervisors offices, and members of the Board provided comments concerning the proposed policy.

On January 15, 2019 (Item No. 70 and 71), regarding County sponsorship of events, the Board directed the Administration to return to the Board at mid-year with a Donation and Sponsorship Policy for consideration and provided comments concerning possible prohibited uses of County funds under a such a County policy.

CONSEQUENCES OF NEGATIVE ACTION

The Board would not adopt Board Policy Manual section 3.68 relating to County Donations and Sponsorships, and Resolution BOS-2013-4 would not be rescinded.

At the request of Supervisor Ellenberg, the Board directed Administration to provide an annual report to the Board relating to the amount of money the County as a whole, each County department, and each Supervisorial District spends on sponsorships.
