FISCAL IMPLICATIONS

As part of the Budget Act of 2019, the Legislature is considering the appropriation of $75 million in one-time funding to the Judicial Council.  In collaboration with the Superior Court, Pretrial Services submitted a $17 million grant proposal on July 2, 2019.

REASONS FOR RECOMMENDATION

Pretrial Services, in collaboration with the Superior Court completed a notice of intent to apply for the funding on June 7, 2019.  The goal of this application is to enhance our current Pretrial programming within our department and with the Superior Court.  Our site provides all of the elements the Judicial Council has requested to be funded since we currently utilize a locally validated pretrial assessment, collect all the data elements requested, provide probable cause summary and release recommendations prearraignment, and many other activities related to pretrial release decision making practices and supervision in the community.  We have worked with the Superior Court to create a request of $17 million for enhancements for our current process, which falls within the guidelines for funding allocations as we are within the large court category. 

All submissions will be submitted and reviewed by the Pretrial Reform and Operations Workgroup (PROW).  This group will make recommendations to the Judicial Council for aware consideration and approval on August 9, 2019.  If awarded, disbursement of funds would occur quarterly over the next two-year period to be fully expended and encumbered by June 30, 2021.

BACKGROUND

As part of the Budget Act of 2019, the Legislature is considering the appropriation of $75 million in one-time funding to the Judicial Council to fund the implementation, operation, and evaluation of programs or efforts related to pretrial decision-making in at least 10 courts.  The Judicial Council released a Request for Applications (RFA) on May 20, 2019.  The application needs to be completed and submitted by July 2, 2019.

CONSEQUENCES OF NEGATIVE ACTION

Pretrial Services would not be able to receive the funds and move forward with implementing the proposed operational enhancements.

STEPS FOLLOWING APPROVAL

COB shall notify Pretrial Services of the approval to receive the funds as appropriated by the Judicial Council of California. Notify Matthew Fisk and Belona Betkolia.
