Public hearing to consider an Ordinance amending various sections of County of Santa Clara Ordinance Code Appendix I, Zoning, for the purpose of regulating Accessory Dwelling Units and Junior Accessory Dwelling Units in accordance with State law, including an option that allows Movable Tiny Homes to further address the regional housing shortage. The Ordinance is statutorily exempt from the California Environmental Quality Act pursuant to Public Resources Code section 21080.17, which exempts the adoption of an ordinance implementing the State law requirements relating to Accessory Dwelling Units. Continued to date uncertain at the request of Supervisor Cortese.

At the request of Supervisor Simitian, the Board directed Administration to report to the Board on date uncertain relating to the addition of language stating that in the -n1 zoning district no more than 800 square feet of an Accessory Dwelling Unit or Junior Accessory Dwelling Unit's floor area may be exempted from the calculation of the floor area ratio.

At the request of Vice President Wasserman, the Board directed Administration to report to the Board on date uncertain with corrections to Section 4.10.015(D)(2) which should refer to 4.10.015(H) and not (I); and, to Section 4.10.015(C)(1) which should read as follows: "Shall have a maximum floor area not exceeding 1,200 square feet or 50% of the legally established floor area of the primary dwelling, whichever is less; however, the maximum floor area shall in no case be less than 800 square feet."

At the request of Supervisor Ellenberg, the Board directed Administration to report to the Board on date uncertain relating to eliminating the requirement of constructing a covered parking space for single family homes in which the detached garage is converted into an Accessory Dwelling Unit.

At the request of Supervisor Cortese, the Board directed Administration to report to the Board on date uncertain relating to options to relax the cosmetic requirement in specific parts of the County mandating that dwellings resemble a cottage or bungalow.
