FISCAL IMPLICATIONS

There is no negative impact to the County General Fund associated with the Recommended Action.

The funding of $133,689.00 to cover the cost associated with the Agreement, for the period of July 1, 2014 through June 30, 2015, for legal guardianship services is included in the Agency’s FY 2015 Recommended Budget.  No additional expenditure appropriation is needed.

CONTRACT HISTORY

On February 14, 2014, the Social Services Agency released a Request for Proposal (RFP) for Legal Guardianship Services for Minors and Caregivers Program (RFP-SSA-FY14-0317) through the County of Santa Clara’s bid management website, www.bidsync.com.  By the proposal deadline of March 13, 2014, the Social Services Agency received three proposals.  All proposals passed the initial screening as being both responsive and responsible.  A three-member Evaluation Committee reviewed the proposals and evaluated them in accordance with the requirements outlined in the RFP.  Based on their consensus review, the Evaluation Committee recommended the Law Foundation of Silicon Valley for the contract award.

REASONS FOR RECOMMENDATION

Law Foundation of Silicon Valley will provide legal information and advocacy services to minors and their caregivers to find an alternative legal means of obtaining a stable living situation, as well as accept court appointments in probate guardianship cases.  Quarterly reports will detail the number of referrals received and their sources, and number of clients served and in what capacity.  The contractor will work with the County to create outcomes regarding services and the stabilization of family living situations.  A standard evaluation tool/satisfaction survey will be administered to all participants.     

This legislative file is requesting the Board of Supervisors accept the recommendation for funding Law Foundation of Silicon Valley for the Legal Guardianship Services for Minors and Caregivers contract for FY2015 with the option of four additional one-year terms based on performance, availability of funding and the need for services.  In accordance with County policies, the Social Services Agency conducted a formal competitive process in which prospective vendors responded to a formal solicitation for delivery of services to the public.

Additionally, pursuant to Board Policy 5.3.5.2(3), the Director of Procurement is authorized to enter into or renew a contract with the same contractor for the same type of services in subsequent fiscal years if the contract maximum for any single fiscal year does not exceed $100,000 and the cumulative total for five years does not exceed $300,000.  All contracts exceeding these thresholds will be returned to the Board of Supervisors for approval.

This contract with the Law Foundation of Silicon Valley will exceed the authority of the Director of Procurement and requires Board approval.

CHILD IMPACT

The recommended action will have a positive impact on the Every Child Safe, Children Living in Safe & Stable Families Indicator as a result of the Law Foundation of Silicon Valley providing legal information and assistance to youth and/or their caregivers regarding guardianship to prevent children from entering the juvenile dependency system.

BACKGROUND

The Law Foundation of Silicon Valley has a long and rich history of youth advocacy and provides legal information and assistance to youth and/or their caregivers regarding guardianship and other alternative placement to prevent children from entering the juvenile dependency system.

The Law Foundation will receive referrals from Catholic Charities Kinship Support Services Program, the Department of Family and Children Services (DFCS) and other community based organizations working with youth. The Law Foundation of Silicon Valley is able to tap into their pool of attorneys whenever a referral is received for immediate assignment and remediation.  Regular program monitoring and utilization reports are submitted to the DFCS. 

CONSEQUENCES OF NEGATIVE ACTION

The agreement with Law Foundation of Silicon Valley relating to providing legal guardianship services for minors and their caregivers will not be approved.

STEPS FOLLOWING APPROVAL

The Clerk of the Board will notify Aleesha Malkani, Carla Cisi and Jackie Howe from the Social Services Agency following the approval of the legislative file.
