FISCAL IMPLICATIONS

There is no adverse impact to the General Fund associated with the approval of the recommended action. This is a Revenue Agreement that would provide Santa Clara County $7,205,550 to help support programs and services that assist parolees reenter their respective communities, family systems and other positive supports.

CONTRACT HISTORY

On February 25, 2014 the Board approved establishment of the Parolee Reentry Services Program at the Reentry Resource Center (RRC) through June 30, 2015. The First Amendment was approved by the Board of Supervisors on January 27, 2015 to extend the term of the agreement through June 30, 2016. The Second Amendment was approved by the Board of Supervisors on June 7, 2016 to extend the term through June 30, 2018, in the amount of $3,587,784.

REASONS FOR RECOMMENDATION

The Office of Reentry Services submitted this agreement to the Board of Supervisors for approval on March 20, 2018 (Item #60). Following Board action, staff discovered that portions of the agreement (exhibits) were missing from the materials provided to the Board of Supervisors and the California Department of Corrections and Rehabilitation (CDCR) made minor adjustments to the agreement previously submitted. The Day Reporting Center Agreement reflecting these minor adjustment is now being resubmitted to ensure review and approval of a completed agreement.

BACKGROUND

On June 21, 2011 the Board of Supervisors approved the cross-system Reentry Network to identify reentry and recidivism strategies, streamline processes to link inmates to effective in-custody and community-based programming, and prepare Santa Clara County for the realignment of parolees and low-level prisoners. The enactment of AB 109, the Public Safety Realignment Act of 2011, shifted state prisoners to California counties where they will serve their jail sentence. This legislative change created an opportunity for the County to modify systems and protocols to accommodate a new offender population and create new strategies while learning from the experience of the first year of AB 109 implementation.

 

CONSEQUENCES OF NEGATIVE ACTION

The County would not be able to use the CDCR funds to support DRC programs. The CDCR funds may not be fully expended, and unspent funds would be returned to the State.

 

STEPS FOLLOWING APPROVAL

The Clerk of the Board of Supervisors is requested to forward Minute Summary of the approval and three executed originals to Javier Aguirre Office of Reentry Services, no later than June 7, 2018, to comply with the State requirements. CDCR requires “wet” signatures on the three originals and will not accept facsimile signatures.
